1. Agreement to These Terms
Culinary Arts Center Inc. ("Culinary Arts Center," "we," "us," or "our") is a corporation registered in New York, located at 3295 Walden Ave, Depew, NY 14043.
These Terms of Service (the "Terms") govern your access to and use of our website at culinaryartscenter.org (the "Site"), your purchase of classes, gift cards, and other products from us, and your participation in classes and events at our facility (together, the "Services").
By using the Site, purchasing from us, or attending a class, you agree to these Terms. If you do not agree, please do not use the Services.
We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Your continued use of the Services after a change means you accept the revised Terms. Purchases already completed are governed by the Terms in effect at the time of purchase.
2. Our Classes
Our classes are interactive, hands-on cooking experiences led by professional chefs in a small-group setting. Each session guides participants through the preparation of a complete multi-course menu using professional appliances, cookware, and ingredients. Aprons and all necessary tools are provided, and every attendee receives a recipe packet. Classes typically run approximately two hours and conclude with a shared meal featuring the dishes prepared during the session.
3. Eligibility and Minors
You must be at least 18 years old to create an account, make a purchase, or otherwise transact through the Site.
Minors under 18 may attend classes when accompanied by a parent or legal guardian who is also registered and present for the entire class. The accompanying parent or guardian assumes full responsibility for the minor's participation, conduct, and safety, and agrees to these Terms on the minor's behalf.
We may set higher minimum ages for specific classes. Any such restriction will be stated in the class listing.
4. Accounts
You may be asked to create an account to complete a purchase. You are responsible for keeping your password confidential and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it up to date. We may suspend or close an account, or refuse a purchase, if we believe the information provided is false or incomplete.
5. Purchases and Payment
Prices are listed in U.S. dollars. Sales tax is added where required. Accepted payment methods are displayed at checkout.
By placing an order, you authorize us to charge your selected payment method for the full amount, including any applicable tax and shipping.
We may change prices at any time. We reserve the right to correct errors in pricing, availability, or product descriptions, even after an order has been submitted. If a pricing error affects your order, we will contact you to confirm or cancel the order before charging you, or we will refund you in full.
We may refuse or cancel any order, and may limit quantities purchased per person, per household, or per order.
Seats are reserved only once payment is complete. Class capacity is limited and seats are sold on a first-come basis.
6. Cancellations, Refunds, and Gift Cards
Cancellations, refunds, transfers, and gift card terms are set out in our Refund and Cancellation Policy, which is incorporated into these Terms by reference.
7. Changes to Classes
We make every effort to run classes as scheduled and as described. Menus, featured dishes, ingredients, and instructing chefs are subject to change without notice due to ingredient availability, chef availability, or other circumstances. A change of menu item or chef is not by itself grounds for a refund.
If we cancel or reschedule a class, your remedies are described in our Refund and Cancellation Policy.
8. Food Allergies and Dietary Needs
Our kitchen prepares dishes containing common allergens, including but not limited to wheat and gluten, dairy, eggs, tree nuts, peanuts, soy, fish, shellfish, and sesame. Shared equipment and work surfaces are used throughout the facility. We cannot guarantee that any dish is free from any specific allergen, and we cannot prevent cross-contact.
If you or a guest in your party has a food allergy, intolerance, or dietary restriction, you must notify us in advance of the class so we can tell you whether we are able to accommodate it. Contact information is in Section 21. We will do our best to accommodate requests made in advance, but we cannot guarantee accommodation, and last-minute requests may not be possible to fulfill.
You are responsible for deciding whether it is safe for you to consume any dish prepared or served during a class. Guests with severe allergies attend at their own risk.
9. Assumption of Risk
Cooking involves inherent risks. These include, without limitation, cuts from knives and sharp equipment, burns from hot surfaces, cookware, oil, steam, and open flame, slips and falls, allergic reactions, and foodborne illness.
By registering for and participating in a class or event, you acknowledge these risks, confirm that you are physically able to participate, and voluntarily assume the risks of participation for yourself and for any minor you enroll.
You agree to follow all safety instructions given by our chefs and staff. Closed-toe shoes are required. Long hair should be tied back, and loose sleeves and dangling jewelry should be avoided. We may decline participation in hands-on activities to any guest who is not dressed appropriately for kitchen safety.
To the fullest extent permitted by New York law, you release Culinary Arts Center Inc., its officers, employees, contractors, and instructing chefs from liability for injuries, damages, or losses arising from your participation, except to the extent caused by our gross negligence or willful misconduct.
10. Conduct at Our Facility
We ask that all guests treat our staff, chefs, and other guests with respect. We may ask any guest to leave, without refund, for behavior that is disruptive, unsafe, harassing, or abusive, or for failure to follow safety instructions.
11. Photography and Recording
We photograph and record classes and events for promotional purposes, including use on our website, social media, email campaigns, and print materials. By attending, you grant us permission to use your likeness in these materials without compensation.
If you prefer not to be photographed, tell your instructor or a staff member at the start of class and we will accommodate you.
Guests may take personal photographs and video during class. Recording that disrupts the class or captures other guests without their consent is not permitted.
12. Intellectual Property
The Site and its contents, including text, photographs, graphics, logos, recipes, recipe packets, class descriptions, and software, are owned by or licensed to Culinary Arts Center Inc. and are protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site and to download or print content for your personal, non-commercial use. Recipe packets provided in class are for your personal use.
You may not reproduce, republish, distribute, sell, license, or otherwise use our content for any commercial purpose without our prior written permission. To request permission, contact us using the information in Section 21.
13. Feedback
If you send us questions, comments, suggestions, or ideas about the Services, we may use them for any purpose without restriction, acknowledgment, or compensation to you. Please do not send us information you consider confidential.
14. Prohibited Activities
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Systematically retrieve, scrape, or compile data from the Site without our written permission.
- Use automated systems, bots, scripts, or purchasing agents to access the Site or make purchases.
- Attempt to gain unauthorized access to the Site, our systems, or another user's account.
- Interfere with or disrupt the Site, its security features, or the networks connected to it.
- Impersonate another person or misrepresent your affiliation with any person or entity.
- Collect usernames or email addresses of other users for unsolicited messaging.
- Harass, threaten, or abuse our employees, chefs, contractors, or other guests.
- Use the Services to advertise or sell goods and services, or in connection with any competing venture.
15. Third-Party Websites and Services
The Site may link to third-party websites or include third-party content. We do not control and are not responsible for third-party sites, their content, or their privacy practices. Purchases made through a third-party site are between you and that third party.
Our store is hosted on Shopify and payments are processed by third-party payment processors. Your use of those services is subject to their own terms and privacy policies.
16. Privacy
Our Privacy Policy describes how we collect and use your information and is incorporated into these Terms by reference. The Services are hosted in the United States. If you access the Services from outside the United States, you consent to your information being transferred to and processed in the United States.
17. Disclaimer and Limitation of Liability
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES.
EXCEPT FOR CLAIMS OF PERSONAL INJURY ARISING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE CLASS, EVENT, OR PRODUCT GIVING RISE TO THE CLAIM.
Some states do not allow certain limitations on warranties or damages. If those laws apply to you, some of the above may not apply and you may have additional rights.
18. Indemnification
You agree to defend, indemnify, and hold harmless Culinary Arts Center Inc. and its officers, employees, contractors, and instructing chefs from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of the Services, your breach of these Terms, your violation of any law or the rights of a third party, or the participation of any minor you enroll.
19. Governing Law, Venue, and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.
Before filing any claim, we ask that you contact us first so we can try to resolve the matter informally. Please allow us thirty (30) days from the date of your written notice to work toward a resolution.
Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Erie County, New York. You and we consent to the personal jurisdiction of those courts and waive any objection to venue there.

21. General
These Terms, together with our Refund and Cancellation Policy and Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. We may assign our rights and obligations under these Terms. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
You consent to receive communications from us electronically, and you agree that electronic notices, agreements, and records satisfy any legal requirement that such communications be in writing.
